WHAT IS VALLEY RIVER VILLAGE?

As a resident, you have a vested interest in your community. The following pages are designed to enhance your Valley River Village experience by providing you with as much information as possible, in capsule form, about this unique community.

Valley River Village is a distinctive residential community that combines premier modern living within a natural setting, for which Eugene has become famous. Throughout the community, a series of meandering ponds, streams, and water features create a tapestry of nature – rich in recreation and style. Valley River Village blends exquisitely designed homes with a natural landscape to create a setting unlike any in the Eugene-Springfield area.

Village Plaza offers a variety of goods and services for all Valley River Village residents. Recognized as the “Premiere Development” in Lane County, Valley River Village is a community within a community offering 104 riverfront and lakefront single-family home sites, 105 additional single-family home sites, apartment, townhome and condominium units, a mini-storage facility, and an 11-acre commercial center, called Village Plaza, all linked by a series of bike and pedestrian paths. With Village Plaza located at the front of the community, you will be able to conveniently fulfill many of your shopping and personal needs.

GOVERNING ASSOCIATIONS

Valley River Village is governed by the Valley River Village Homeowners Association, Inc. Master Association, an Oregon nonprofit corporation. To the extent permitted by the Valley River Village master documents, each of the eleven (11) subdivisions are governed by an association established for the respective subdivisions, the Sub-Association.

The Master Association is managed by a Board of Directors consisting of eleven (11) members (refer to organizational chart next page). The eleven-member board is made up of one Director from each subdivision of Valley River Village (contact information regarding the board of directors is mailed yearly with 1st quarter invoices). Each of the members of the Board of Directors has one (1) vote in the affairs of the Master Association, regardless of the size of the subdivision or its assessment, the board of directors designated for their subdivision acts as the voice for the homeowners living in their designated subdivision. The regulations governing the Board of Directors are contained in the Master Association’s recorded Bylaws. The Master Association manages and maintains Valley River Village Community Open Spaces and Common Areas such as streams, ponds, pathways, wooded reserves, greenways, other planting areas, and sidewalks. The Master Association’s responsibilities are to:

  • Enforce the Valley River Village Covenants, Conditions, and Restrictions (copies will be with your purchase documents or can be obtained from any local title company).
  • Maintain, repair, and improve Valley River Village common area and community open spaces.
  • Prepare the annual budget and assess the membership for the costs required to manage and maintain Valley River Village. Appoint and monitor the activities of the Valley River Village Architectural and Landscape Control Committee (which must approve all improvements within Valley River Village).
  • Homeowners meetings are held twice a year (notices of scheduled meetings with dates, times and locations are included with the 1st quarter invoices every year). Special and or Emergency meetings are also called by the Board of Directors on an as-needed basis.

The Sub-Associations have the responsibility to maintain their own properties and to participate in the Mater association by appointing a member to the Association’s Board of Directors.

ASSESSMENTS

After the Board of Directors has prepared the annual budget, the budget is divided by the total buildable acreage in Valley River Village. Buildable acreage is the acreage of the development after common areas acreage has been excluded. The result is the Assessment Per Acre, which is then allocated to the separate subdivisions.

Single-family lot owners of the platted subdivisions are assessed equally, based on the total adjusted acreage of all of the single-family platted subdivisions.

Assessments are determined annually by the Board of Directors and are payable on a quarterly basis at the beginning of each quarter.

Assessments

Assessments are due and payable on the 15th of the first month of the quarter. The quarter invoice will be e-mailed the last week of the month prior to the quarter’s beginning. The following is the due date for the quarter assessments: January 15th, April 15th, July 15th, and October 15th. Homeowners may elect to pay for the entire year instead of quarterly, in the event the homeowner chooses this payment plan, contact the Association for an invoice representing the entire year.

Pay of Lien Letter

Any owner that is thirty (30) days or more delinquent may receive a “Lien Letter” for a request of payment in five days of receipt of the “Lien Letter.”

Assessment Lien

If the delinquent owner does not bring his or her account current within the time set forth in the “Pay of Lien Letter,” the Association will record a lien with the County recorder’s Office. The lien will set forth the number of delinquent assessments, interest and attorney’s fees, and any other cost incurred by the Association.

COMMON AREA RULES

The Master Association has established the following rules and regulations concerning the use of the common areas, subdivisions, and facilities:

Man-Made And Natural Ponds

Man-made and natural ponds are for the enjoyment of all Valley River Village residents. Each style of pond has its own rules governing its use.

Man-Made Ponds

Man-made ponds are designed for aesthetic purposes – solely as visual features. No other use may be made of these ponds. Therefore, any use such as wading or swimming is not permitted. Fishing is not allowed. Planting of fish is prohibited. Residents must exercise extreme care around the ponds to avoid damage to the environment and mechanical equipment. Feeding natural wildlife in and around the ponds is prohibited. Littering is also prohibited.

Natural Ponds

Natural ponds are also to be treated and used for aesthetic purposes only. These ponds are designated as protected wetlands by the City of Eugene and the State of Oregon and must be treated as such. All vegetation is and around these ponds must be left undisturbed – picking flowers, cutting grass, removing vegetation, applying herbicides, etc. is prohibited. No other uses, such as wading or swimming, are permitted. Littering of any kind is prohibited. Residents may not apply poisons of any kind to the water, including pesticides.

Pathways

Valley River Village has both private and public pathways. The private pathways are clearly marked with “Private Property” signs and are blacktop, public pathways are concrete. Use of the private pathways is limited to residents of Valley River Village. Rules governing the use of these pathways include:

  • Giving the right-of-way to pedestrians at all times.
  • Keeping to the right when walking or riding; passing on the left at all times.
  • Bicycle riding only on the paved surface; residents must protect the landscape environment by not riding on dirt or landscaped area. Bike riding off the paved surface is prohibited.
  • Motorized vehicles are prohibited.
  • Clean up after your pets and keep them leashed, abide by City of Eugene Pet Rules and Regulations.

Maplewoods Reserve

The prove of trees that lies between the Riverwalk and Riverplace subdivisions is a Valley River Village common area, known as the Maplewoods – to be left undisturbed for the enjoyment of all residents. To maintain its purpose as a natural habitat for wildlife and native vegetation, the following rules have been adopted:

  • Use of the Maplewoods is limited to waking on designated paths.
  • Disruption of the native vegetation is prohibited except for the removal of invasive species, including blackberries and scotch broom, by the responsible association.
  • The Maplewoods are part of the common areas, use is restricted to Valley River Village residents, occupants, and employees of Valley River Village. All other persons are prohibited from entering this area.

Willamette Greenway

A portion of Valley River Village is located in an area known as the Willamette Greenway. This parcel runs along the Willamette River, bordering the Riverwalk and Riverplace Subdivisions. It is owned by The Master Association, governed by the rules and regulations set not only by the Association but also by state and municipal authorities. These rules include:

  • Activities within the Greenway are limited to temporary recreational use on a daily basis and provide members of the general public access to the Willamette River.
  • Biking, jogging, walking, bird watching, and nature walks are all permitted activities.
  • Camping, woodcutting, rock collecting, flower picking, drinking alcoholic beverages, use of any controlled substance or drug, driving or operating motorized vehicles of any kind, playing loud music, littering, picnicking, swimming, or fishing are all prohibited activities within the Greenway.

General Design Guidelines

  • Minimum Square Footage Residential Homes 2,000 square feet
  • Fencing shall be wrought iron, and or brick or stone
  • Exterior siding shall be cedar, redwood wood siding, synthetic plaster, brick or stone veneer
  • Roofing material shall be taper sawn shakes (see below adopted architectural rules and design), clay or concrete tile, or American camwood tile. Minimum roof pitch 4:12
  • Exterior color schemes shall be muted natural colors
  • Address Plate and Mailbox (contact Association for requirements)
  • Only one living unit is allowed per home site, no mobile homes or structures are permitted other than living units, garages, swimming pools, fences, and noncommercial greenhouses
  • Landscaping front and backyard and street tree(s) required
  • Approval required from the Architectural & Landscape Review Committee
